Zest Gym – Membership & Direct Debit Terms and Conditions
1. Agreement
1.1 This Membership Agreement is
between Twisted Zest Limited trading as Zest Health and Fitness (“Zest
Gym”, “We”, “Us”, “Our”) and the member (“You”).
1.2 This Agreement is governed by the laws of England and Wales and
the Consumer Rights Act 2015.
1.3 The Agreement becomes binding once your membership application has been
accepted and payment has been received.
2. Membership Access
2.1 Membership allows access to available gym facilities including the main gym floor, equipment, Mixed Martial Arts training area, and studio when classes are not taking place. Standard group classes may be included depending on membership type; premium classes may incur additional fees.
2.2 Access to facilities and classes may be limited due to capacity, maintenance, or operational requirements. Opening hours and available facilities may change from time to time.
2.3 Upfront memberships provide access only for the prepaid period.
2.4 Minimum term memberships require commitment for the agreed duration. No refunds will be issued for early cancellation unless required under UK law.
2.5 Flexible memberships operate on a rolling monthly basis and require 30 days’ written notice to cancel.
3. 24-Hour Access & Unmanned Training
3.1 Members may access the gym during unmanned hours. By entering the gym during these times, you acknowledge that training is entirely at your own risk.
3.2 Staff may not be present during unmanned hours. Members are responsible for their own safety and for using equipment correctly.
3.3 Each member is issued a personal PIN or access credential to enter the gym.
3.4 PINs must never be shared with anyone, including other members.
3.5 Every member must enter the gym using their own individual PIN. Allowing another person to enter without their own access credentials is strictly prohibited.
3.6 Any member found sharing their PIN, allowing unauthorised access, or attempting to bypass access controls may have their membership immediately terminated and access permanently banned.
4. CCTV & Security
4.1 CCTV operates throughout the facility for safety, security, and monitoring of member access.
4.2 By entering the gym, you acknowledge and consent to being recorded by CCTV for the purposes of safety, crime prevention, and ensuring compliance with gym policies.
4.3 CCTV footage may be used to investigate breaches of these Terms, including PIN sharing or unauthorised access.
Section 5 – Payments (Direct Debit)
5.4 Direct Debit payments will continue to be collected monthly after the expiry of any minimum membership term and will automatically roll onto a monthly rolling membership until the required cancellation notice has been received and processed.
5.5 Cancelling your Direct Debit directly with your bank does not cancel your membership. Membership can only be cancelled by providing the required written notice to Zest Health and Fitness in accordance with these Terms and Conditions.
5.6 Member Responsibility
It is the member's responsibility to cancel their membership and Direct Debit through ClubRight by providing the required 30 days' written notice. Direct Debit payments will continue on a rolling monthly basis after the expiry of the minimum term until such notice is received and processed. Cancelling the Direct Debit directly with your bank does not cancel your membership, and any outstanding membership fees remain payable.
5.7 Unauthorised Direct Debit Cancellation
Where a Direct Debit is cancelled without the required notice or while a minimum term remains outstanding, Zest Health and Fitness reserves the right to recover any unpaid membership fees, refer the outstanding balance to a debt recovery agency, and recover any reasonable administration and debt recovery costs where permitted by law.
6. Freeze Policy
6.1 Membership may be frozen for up to 12 months in cases of pregnancy (evidence may be required).
6.2 Membership may be frozen for up to 3 months due to injury, illness, or personal circumstances at our discretion.
6.3 Freeze requests must be submitted in writing and will apply from the date approved by us.
6.4 Membership will automatically resume at the end of the freeze period.
7. Cancellation
7.1 Minimum term memberships cannot be cancelled before the expiry of the agreed minimum membership term except where required by applicable law or in accordance with Clause 7.3 below.
7.2 Rolling (flexible) memberships require 30 days' written notice to cancel. Membership fees will continue to be payable throughout the notice period.
7.3 Early termination of a minimum term membership may be considered where You permanently relocate to an address more than 45 minutes travelling time from Zest Health and Fitness. Requests must be submitted in writing and supported by satisfactory proof of relocation, such as a tenancy agreement, mortgage completion statement or utility bill showing the new address. Approval is at the sole discretion of Zest Health and Fitness.
7.4 All outstanding membership fees, charges and any other sums due under this Agreement must be paid in full before cancellation takes effect.
7.5 Default of Agreement
You will be deemed to be in default of this Membership Agreement if You:
- Fail to make any membership payment when it falls due;
- Cancel Your Direct Debit without following the required cancellation procedure;
- Attempt to avoid payment of membership fees during the minimum membership term; or
- Otherwise breach the terms of this Membership Agreement.
Upon default, the remaining balance for the entire unexpired minimum membership term shall immediately become due and payable in full, without further notice.
Zest Health and Fitness reserve the right to recover the full outstanding balance of the minimum membership term, together with any reasonable administration costs, legal costs and debt recovery costs incurred in recovering the debt, where permitted by law.
Cancelling Your Direct Debit directly with Your bank does not cancel Your membership. You will remain liable for all membership fees due under this Agreement until Your membership has been properly cancelled in accordance with these Terms and Conditions.
8. Health & Safety
8.1 Gym equipment must be used safely and correctly at all times.
8.2 A gym induction is available to help members learn how to use equipment safely.
8.3 In the absence of negligence by Zest Gym or its staff, use of facilities and equipment is entirely at your own risk.
8.4 We reserve the right to refuse entry, suspend, or cancel membership if behaviour risks injury, damages equipment, or causes disruption to other members.
9. Termination by Zest Gym
9.1 We reserve the right to terminate memberships with one month’s written notice.
9.2 If termination results from a breach of these Terms (including misconduct, equipment misuse, or access violations), no refund will be issued.
10. Non-Transferable Membership
Memberships are personal and non-transferable and may not be assigned or transferred to another person without our written consent.
11. Statutory Rights
Nothing in these Terms limits your statutory rights under the Consumer Rights Act 2015 or any other applicable UK legislation.
